Entering via US, starting to panic

So I'm starting to freak out. I've got my letter of introduction to Canada, have also applied for the visa waiver program and payed the $14 and had my passport authorised through the Electronic System for Travel Authorization(ETSA), yet I'm still freaking out that I might not be let into the US.
Here's my scenario. I fly out of Sydney to LA on the 30th of August. I plan to be in LA for 5 days, then head to Vegas to do a contiki tour, which will last a further 8 days. At the completion of the tour (which ends in LA) I will fly to Vancouver and enter Canada using my letter of introduction. This will happen around the 15th-17th of September. At the US border I assume I have to provide proof that I will be leaving the US after my short visit, which will be fine as I will have a flight itinerary to depart to Vancouver.

I'm super stressed about this, as I was under the impression that I could enter the US under the visa waiver program as I am an Australian, and my stay is well under the 90 day period allowed under the program. I've just been informed that under the visa waiver program, any time spent in Canada counts towards the maximum of 90 days. It also says, that if you are transiting the US on a 6 month trip to Canada (which I will be doing) you cannot travel on the visa waiver program, as my total stay in the US/Canada etc exceeds the 90 days. It's suggested that I apply for the B-1/B-2 "visitor" visa.

Is this correct for me, even though I wouldn't have actually spent any time in Canada, prior to entering the US? I'm worried that I've left it too late to apply for the visitor visa if required, as it's only 4 weeks until I depart. What should I do? I'd hate to fly all the way to LA on a non refundable ticket and be denied entry and have to turn around and come straight back to Australia. Please help!!

Hey Karl,

You'll be absolutely fine. I know several people who have done something similar to you (spent time in the US before coming to Canada to work) and you've got nothing to worry about. If you're worried about it, what you probably should do is hand in your 90 day visa when you leave the US. That way you can just apply for another one when you leave the country again - if you're flying, they generally take it out anyway when you leave the country.

Those terms cause so much confusion, but their law only stretches as far as their border... I have even had multiple VWP's in my passport at one stage and just had a US border guard tut-tut me and take them out, then put my new one in.

I know this is a bit late to help you, Karl, but I've never had a problem with the US VWP. I have at one point, exited the USA going to Vancouver, and then exited Vancouver to Europe. They didn't even take my VWP out of my passport when I left the country. That was years ago, and I've not had any problems reentering the country. Ultimately I think they're more interested in the stamp that says you left the USA.
While on my WHP in Canada, I consider myself a resident of Canada for journeys into the US, and have so far had 2 trips to the US in the last year, with no concerns arising about the duration of my US VWP.

How did you go with the all this Karl? Did you need a US B2 Visa or was it all good to transit through the USA with the Visa Waiver Program before entering Canada. I might go through a similar issue in March next year. Any feedback would be great.

Currently stressing about a similar situation!

Have started all the processes for the US B1/B2 Visa, but after reading some posts on this forum I'm now starting to think I'll be fine with a VWP?

I'm flying BNE - LAX - YYZ on a one-way ticket, and will be entering Canada as a visitor until my WHP comes through, then driving in and out of the states to activate it.

Will I be fine on the VWP? I don't want to annoy any immigration people because my fiance is Canadian and I'm planning on being in Canada for a long time..
